Terms of Service

These Terms of Service constitute a legally binding agreement between you and S-IMSY Limited. By downloading, accessing, or using the TravelSIMSY application or any eSIM services provided by TravelSIMSY, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.
1. About Us
TravelSIMSY is a consumer brand of S-IMSY Limited, a company registered in England and Wales (the "Company", "we", "us", or "our"). S-IMSY Limited provides mobile data connectivity services to travellers through the provision of eSIM technology and an accompanying mobile application (the "App").
Throughout these Terms, "TravelSIMSY", "the Service", or "Services" refers to the eSIM data services, mobile application, website, and all related platforms and tools provided by S-IMSY Limited under the TravelSIMSY brand.
References to "you", "your", or "Customer" refer to any individual who accesses, downloads, registers for, or uses any TravelSIMSY service.
2. Acceptance of Terms
By creating an account, purchasing an eSIM, downloading the TravelSIMSY App, or otherwise using any of our Services, you confirm that you have read, understood, and agree to be bound by these Terms of Service, together with our Privacy Policy and Cookie Policy.
If you do not agree with any part of these Terms, you must not use the Service and should immediately discontinue use of the App and delete any eSIM profiles associated with TravelSIMSY from your device.
We may update these Terms from time to time. Updated Terms will be made available within the App and on our website. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. We will endeavour to provide reasonable notice of material changes.
3. Eligibility and Age Restrictions
3.1 You must be at least 18 years of age to create an account, purchase credit, or enter into any agreement with TravelSIMSY. By using the Service, you represent and warrant that you are at least 18 years old.
3.2 Persons under the age of 18 are prohibited from creating an account or purchasing Services. If we discover that an account holder is under the age of 18, we reserve the right to immediately suspend or terminate the account without notice or liability.
3.3 Under UK GDPR, the digital age of consent for the processing of personal data in connection with information society services is 13 years. However, as the account holder and contracting party must be 18 or over, any use of the Service by a person under 18 must be under the direct supervision and responsibility of the adult account holder.
3.4 The account holder assumes full responsibility for any use of the Service by persons to whom they provide access, including minors under their supervision.
4. Device Compatibility
To use the Service, you must have an eSIM-compatible and network-unlocked device. It is your sole responsibility to verify that your device supports eSIM technology and is compatible with the TravelSIMSY service before making any purchase.
TravelSIMSY publishes a list of compatible devices within the App and on our website. This list is provided for guidance only and may not be exhaustive. Newly released devices may not yet be listed.
We are not liable for any failure of the Service caused by device incompatibility, carrier-locked devices, or software restrictions imposed by your device manufacturer or mobile network operator.
5. The Service
5.1 TravelSIMSY provides prepaid mobile data eSIM services for travellers. We provide a mobile application to manage your eSIM profiles, purchase data plans, monitor usage, and access customer support.
5.2 We publish coverage maps and country availability information within the App and on our website. This information is accurate at the time of publication; however, coverage is subject to change due to commercial relationships between network operators, groups of operators, and regulatory decisions in individual countries.
5.3 Our Services rely on third-party mobile network operators and interconnection arrangements. We cannot be held responsible or liable for the unavailability, interruption, or degradation of service that is beyond our network and outside of our reasonable control, including but not limited to failures of third-party networks, roaming partners, or international interconnects.
5.4 While we take commercially reasonable steps to provide a professional, reliable service, due to the inherent nature of telecommunications, we cannot guarantee that the Service will be uninterrupted, fault-free, error-free, or available at all times. We shall not be held liable for any losses arising from temporary service disruptions, network outages, or degraded performance caused by factors outside our reasonable control.
5.5 Data speeds may vary depending on the local network conditions, device capabilities, network congestion, and fair usage policies applied by our roaming partners. We do not guarantee any minimum data speed.
6. Customer Responsibilities
6.1 It is your responsibility to ensure that you have sufficient credit on your TravelSIMSY account before and during your travels. We are not responsible for any inconvenience or loss arising from insufficient credit.
6.2 You must test and verify that the eSIM and data service works correctly on your device before travelling to your destination. We strongly recommend installing and testing your eSIM at least 24 hours prior to departure. Failure to test the service in advance does not entitle you to a refund.
6.3 You are responsible for ensuring that your device settings are correctly configured for eSIM use, including but not limited to enabling data roaming where required.
6.4 You must keep your account credentials secure and must not share your login details with any third party. You are responsible for all activity on your account.
7. Coverage and Availability
TravelSIMSY publishes coverage information indicating the countries and regions where our eSIM services are available. This coverage information is correct at the time of publication and is subject to change without prior notice.
Changes to coverage may occur due to: alterations in commercial agreements between mobile network operators; regulatory changes in individual countries; government sanctions, embargoes, or trade restrictions; technical issues affecting international interconnects; or force majeure events.
We will use reasonable endeavours to keep coverage information up to date but cannot guarantee that published information will always reflect real-time availability.
8. Sanctioned and Embargoed Countries
TravelSIMSY complies with all applicable UK sanctions legislation, including regulations made under the Sanctions and Anti-Money Laundering Act 2018, as well as relevant United Nations Security Council resolutions.
We will not provide Services in countries or territories that are subject to comprehensive UK Government sanctions, embargoes, or trade restrictions. The list of such countries is determined by reference to the UK Sanctions List maintained by the Foreign, Commonwealth and Development Office (FCDO).
It is your responsibility to be aware of and comply with all applicable sanctions, export controls, and trade restrictions when using the Service. If you attempt to use the Service in a sanctioned territory, we reserve the right to suspend or terminate your account without notice or refund.
9. Acceptable Use Policy
You agree to use the TravelSIMSY Service only for lawful purposes and in accordance with these Terms. You must not use, or permit others to use, the Service for any of the following:
- 9.1 Any illegal activity or any activity that would constitute a criminal offence under the laws of England and Wales or any other applicable jurisdiction.
- 9.2 Sending, receiving, uploading, downloading, or facilitating any material that is obscene, offensive, defamatory, threatening, abusive, harassing, or hateful.
- 9.3 The transmission of unsolicited commercial communications (spam), bulk messaging, or any form of nuisance communication.
- 9.4 Any activity that interferes with, disrupts, or imposes an unreasonable burden on the network, or that could damage, disable, or impair the operation of the Service.
- 9.5 Attempting to gain unauthorised access to any part of the Service, other accounts, computer systems, or networks connected to the Service.
- 9.6 Reselling, redistributing, or commercially exploiting the Service or any data obtained through the Service without our prior written consent.
- 9.7 Using the Service in any manner that could bring TravelSIMSY or S-IMSY Limited into disrepute.
We reserve the right to suspend or terminate your access to the Service immediately and without notice if we reasonably believe you are in breach of this Acceptable Use Policy.
10. Content Filtering
TravelSIMSY may apply content filtering on its network in accordance with applicable UK legislation and regulatory requirements, including Ofcom guidance on network-level content filtering.
Where content filtering is in place, adult or age-restricted content may be blocked by default. Account holders aged 18 or over may request the removal of content filters by contacting our customer support team, subject to appropriate age verification.
As our Service is delivered through third-party network operators, additional content restrictions may be applied by those operators in accordance with the laws and regulations of the country in which the service is being consumed. We have no control over content filtering applied by third-party networks.
11. Payments and Credit
11.1 All eSIM plans and credit are prepaid. Payment must be made at the time of purchase through the payment methods accepted within the App.
11.2 Prices are displayed within the App and are inclusive of VAT where applicable. We reserve the right to change our prices at any time, but price changes will not affect purchases already completed.
11.3 Payment is processed through authorised third-party payment service providers. By making a purchase, you agree to the terms and conditions of the relevant payment processor. TravelSIMSY is not responsible for any additional charges imposed by your bank, card issuer, or payment provider.
11.4 We make clear within the App and on our website how credit is consumed, including data usage rates for each country and plan type.
11.5 It is your responsibility to monitor your credit balance and ensure sufficient credit is available for your needs.
12. Credit Expiry
Any credit held on your TravelSIMSY account will be invalidated and forfeited after a continuous period of 24 months of no usage (no data consumption, no purchases, and no account activity).
This policy exists to maintain proper accounting principles and to comply with applicable financial reporting obligations.
We will endeavour to notify you via the email address associated with your account prior to any credit forfeiture. However, it is your responsibility to ensure your contact details are kept up to date.
Forfeited credit cannot be reinstated, refunded, or transferred.
13. Refund Policy
13.1 As our eSIM services are digital products that are activated and delivered immediately upon purchase, we do not offer refunds as a general policy.
13.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a legal right to cancel a purchase of digital content within 14 days. However, by purchasing and activating an eSIM, you expressly consent to the immediate provision of the digital content and acknowledge that you lose your right of cancellation once the eSIM has been activated or data consumption has commenced.
13.3 In exceptional circumstances, where you have been unable to use the Service due to an error or fault attributable to TravelSIMSY, we may, at our sole discretion, offer a replacement service or credit to your account.
13.4 No refunds will be issued in the following circumstances:
- You purchased an eSIM without verifying device compatibility
- You failed to test the Service before travelling
- You did not have sufficient credit
- The service was unavailable due to third-party network issues outside our control
- You travelled to a sanctioned country
- Your account was suspended due to a breach of these Terms
13.5 Any refund request must be submitted within 14 days of the issue arising by contacting our customer support team. We will investigate all refund requests in good faith.
14. Suspension and Termination
We reserve the right to suspend or terminate your access to the Service, without notice and without liability, if:
- 14.1 You breach any provision of these Terms of Service.
- 14.2 You use the Service in a manner that is not consistent with the Acceptable Use Policy.
- 14.3 We reasonably suspect fraudulent, illegal, or unauthorised activity on your account.
- 14.4 We are required to do so by law, regulation, or by order of a competent authority.
- 14.5 We discontinue the Service or any part of it.
Upon termination, any unused credit on your account will be forfeited unless termination is due to an error attributable to TravelSIMSY, in which case credit may be refunded at our discretion.
15. Limitation of Liability
15.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
15.2 Subject to clause 15.1, we shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or loss of goodwill, arising out of or in connection with your use of the Service.
15.3 Our total aggregate liability to you for all claims arising out of or in connection with these Terms or the Service shall not exceed the total amount paid by you for the Service in the 12-month period immediately preceding the event giving rise to the claim.
15.4 We shall not be liable for any failure or delay in providing the Service to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to: failures of third-party networks, internet service disruptions, natural disasters, acts of government, pandemic, or any other force majeure event.
16. Intellectual Property
All intellectual property rights in the TravelSIMSY App, website, branding, logos, content, software, and Services are owned by or licensed to S-IMSY Limited. This includes copyright, trademarks, trade secrets, know-how, and design rights.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use in connection with the Service. You must not copy, modify, distribute, sell, or lease any part of the App or Service, nor reverse-engineer or attempt to extract the source code.
17. Data Protection
We process personal data in accordance with our Privacy Policy, which should be read alongside these Terms. By using the Service, you acknowledge that we will process your personal data as described in our Privacy Policy.
We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 in all processing of personal data.
18. Third-Party Services
The Service may contain links to or integrations with third-party websites, services, or applications. We are not responsible for the content, terms, privacy practices, or availability of any third-party services.
Your use of third-party payment processors, app stores, and other external services is subject to their respective terms and conditions.
19. Indemnity
You agree to indemnify and hold harmless S-IMSY Limited, its directors, officers, employees, agents, and affiliates from and against all losses, costs, charges, demands, proceedings, damages, actions, expenses, and claims arising out of or in connection with: your breach of these Terms; your use of the Service otherwise than in accordance with these Terms; or any claim by a third party arising from your use of the Service.
20. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to your statutory rights as a consumer to bring proceedings in the courts of your country of domicile.
21. Complaints
If you have a complaint about the Service, please contact our customer support team through the App or by emailing the address provided on our website. We will acknowledge your complaint within 5 working days and aim to resolve it within 30 days.
If you are not satisfied with our resolution of your complaint, you may have the right to refer the matter to an alternative dispute resolution body or to the courts.
22. General Provisions
22.1 Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and S-IMSY Limited concerning the Service and supersede all prior agreements, representations, and understandings.
22.2 Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
22.3 Waiver. No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall it prevent any future exercise of that or any other right or remedy.
22.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any third party without your consent.
22.5 Notices. We may provide notices to you via the App, by email to the address associated with your account, or by posting on our website. It is your responsibility to keep your contact details up to date.
22.6 Third-Party Rights. These Terms do not confer any rights on any person or party other than you and S-IMSY Limited under the Contracts (Rights of Third Parties) Act 1999.
